Default Unlawful eviction

Hi All,

I have got myself into an unlawful eviction situaton and need to know the people with the best advice. Tenants only been in two weeks and stupidly I gave them benefit of doubt with regards to rent and they owe 190 but they also agreed to give me access to benefit claim of which they have lied.
Thinking this was only going to get worse I went down to collect letting board with a family member but also to question rent etc, I told him I wasn't happy and he flung keys at me then stormed off. I entered property on a safety issue and found not only a dog which wasn't agreed but also a bed in spare room with woman's effects which he claims is his mothers but again not agreed. Then in their room was a set of scales and a couple of safes which looked like evidence of drug dealing.
After locking up I received solicitor nptice stating unlawful eviction and they want back, I phoned police and they wanted into the property.
Therfore I telephoned local solicitor who went balistic stating I must give keys back as they'll sue me upto 10000 pounds and that I should write the six months off and hope they don't sue.I telephoned landlord.action who said to issue section 8 and 21 to get them out at cost of 98 pound, in the meantime this solicitor rang back and said to meet up next week for a couple of hrs at a cost of 140 per hr and to not let the police in without a warrant as it would interfere with their quiet enjoyment of the property as per tenancy and that I should not have gone into the house even on the safety issue.
With regards to dog I dropped it off at his parents, Therfore I called police off and gave the keys back not expecting any rent at all npw this month.

Landlord action recommend section 8 etc but solicitor says if I do that they'll countersue woth unlawful eviction, I can't afford expensive solicitors so who do I trust landlord action solicitor or join nla and what can they do.

Let cops in but ask them to get a warrant

Sols can claim what they want BUT if you provide evidence of a crime and a Sol starts claiming you breaching a civil law and should not tell them them Sol could have a problem.

Hi Odecar,

i was on a tight time limit as to handing keys back therefore took the solicitors advice and told police i couldn't let them in although they did say they may take the matter up themselves.
Who is the best body to go to with regards defence in a possible unlawful eviction case ( although total bull as they have lied constantly about various things )

There solicitor saying you could not enter on safety is total Cr**p.

Assuming you have gas connnected to property my story is i was rang by a passer by saying they could smell gas (they saw your number on the let board) you then went down to property as a precaution (You have a right to enter the property).

Thats your story for gaining entry.There Quiet enjoyment comes second to the house and street being blown up.

On entry you found no smell:

You did notice the scales & safes so you did your public duty and called the police.

The tenant also lied from the outset Re:Benefits.

So they in effect took up tenancy under false pretences which invalidates the tenancy agreement.

I would follow the advice of landlord action & also join the NLA.

Can you imagine the judges reaction if there was indeed a gas problem

:Judge the solicitor told me i could not enter the property even under on the safety issue:

Stick with the people who deal with these issues day in and day out.
