| | Pension Credit Rent and Joint Venture Purchase I'm currently doing an assisted sale for an eldely asian lady. She is in receipt of guaranteed pension credit and wants to sell her flat in the south west and use the sale proceeds to reinvest in a flat in London so she can be amongst her own community. She needs someone to get the mortgage as she's too old for one. She wants to own the property as she needs the security of knowing she has some control over her home.
She is extremely lonely and sad and the loneliness is making her ill.
Her flat is mortgage free. She inherited it from her mother. Mother and daughter have been living life as a recluse in the UK ever since they were forced out of their own country (Uganda) 40 years ago.
I know its possible for the sale proceeds not to be taken into account as capital provided all the sale proceeds are reinvested to buy your own home. In this situation the lady needs someone to get the mortgage in their name and she will put down the deposit money (approx £70k) but I need to make sure this is going to be legally do-able first.
I need to find out if she'll be eligible to get her rent paid once the flat is bought. I know if the council think the purchase is not a genuine one (contrived) then they will refuse her claim for rent.
So far I have not been able to find anyone who can advise her.
