Default LHA redirection?

Hi again

My letting agent has found an LHA tennant for my property, but as i had a bad experience last year with tennants miss using there rent and not paying me, i have asked for the tennant to get the rent paid direct to me, L/A have told me they are getting it sorted but should i let her move in before im 100% certain i have the rent paid to me? because i dont trust the L/A, my fear is they let her move in then she comes up with a story saying they wont pay me rent direct and then she stops paying rent?

Is it important to get landlord redirection? or ami being to cautious, they do have a guarantor.

As of 1st April, you can get LHA paid direct if it is a condition of the landlords tenancy agreement - so you should have no problems IF you have a clause in your AST saying that eviction proceedings will occur if the landlord is NOT paid the LHA directly.

I was add to Paul's reply that the DWP guidance is to give LHA direct if the landlord has reduced the rent to enable the tenant to secure and retain the tenancy.

So basically as long as you are not charging above the tenants LHA entitlement, you will be okay.

However, make sure that you have a letting agent that knows LHA! Many don't.

Mornin

In Donny you can get direct from day 1 if you charge the LHA rate..another way of doing it is to charge the LHA rate and charge £10 per week contribution to bills .

Default Tenancy agreements

There was an interesting interview yesterday on BBC world 24-hour news with Ray Woolford of the RLA. The discussion was on the changes that the Government are bringing in via article 4.

If you wish to see the interviews they were broadcasted at 08:10 to 08:15 and 09:10 to 09:15. In the second interview a representative of Shelter was present.

In the initial interview Ray said
1 - when an Assured Shorterm Tenancy Agreement is issued and it is allowed to run without being renewed it becomes an Assured Tenancy after two years. He went on to say it then becomes more difficult and expensive to evict the tenant.

Many of our tenants have been with us for longer than 2 years. It is our believe that we can serve a section 21 on our tenants when we require our property back, once the initial six months have lapsed, and give no reason.

Can anyone expand further on the idea that an Assured Shorterm Tenancy Agreement becomes an Assured Tenancy after two years?

2 - He went on to say he favoured the lease idea but was not given the time to explain further. Anyone have any idea what this encompasses?
